Terms and conditions

1. Interpretation

       Throughout these Terms and Conditions, the term "DC Clean" shall be interpreted to mean and refer       

       collectively to the DC Group of companies, which includes DC MANAGEMENT & CLEANING SERVICE SDN 

       BHD, HAWKYZ CLEANING SERVICES SDN BHD, and KURINA CLEANING SERVICE SDN BHD

 

   2. Scope and Applicability

   a) These terms apply to all companies within the DC Group, including DC Management & Cleaning Service Sdn 

       Bhd, Hawkyz Cleaning Services Sdn Bhd, and Kurina Cleaning Service Sdn Bhd.

 

   b) While use of the Platform is currently free for non-corporate account users, DC Clean reserves the right to 

       introduce a platform fee at any time, provided users are notified and given the option to terminate their

       account.

 

   3. Charges and Payment Terms

   a) Structure of Charges: By using these services, you agree to pay all applicable "Charges," which include service 

       fees, transportation costs from assigned service personnel, and any relevant taxes imposed by the government

       from time to time.

   b) Price Fluctuations: Charges are subject to change based on supply, demand, and other external factors. DC

       Clean reserves the absolute right to adjust these charges based on actual circumstances.

   c) Currency: All quotes and transactions are in Ringgit Malaysia (RM).

   d) Due Date: Payment is due immediately upon placing an order and will be deducted from your DC Clean Wallet

       or your designated payment method.

   e) Add-on Fees: Any priority or add-on fees are voluntary; however, once selected, shall become part of the 

       mandatory Charges.

   4. Service Availability and Cancellations

   a) Resource Availability: All service requests are subject to the availability of resources. If an application cannot be

       processed, DC Clean will notify you via email, text message, call, or push notification based on the contact

       details provided by you to DC Clean.

   b) Refund Discretion: DC Clean maintains full discretion regarding whether to refund the equivalent sum if a       

       request cannot be processed. Generally, all paid Charges are non-refundable unless determined otherwise by

       DC Clean on a case-by-case basis.

   c) Cancellations: You may cancel a service request at any time before the arrival of the assigned service

       personnel; however, a cancellation fee may be applied without prior notice.

 

   5. Payment Methods and Liability Waivers

       You may choose to pay the Charges by the following method:-

   a) Cash Payment: If you elect to pay by cash, payment of the full Charges shall be made by you directly to the

       assigned service personnel upon completion of the service, unless otherwise agreed by DC Clean. You are

       responsible for ensuring that the correct amount is paid and DC Clean reserves the right to refuse service or

       suspend future service requests in the event of non-payment.

   b) Third-Party Processors: When paying via Electronic Payment Gateways or Credit Cards, the transaction is

       subject to the terms of the third-party Payment Processor. DC Clean is not responsible for unauthorized use of

       your payment instruments, errors made by the Payment Processor, or technical faults on their end. Any

       payment-related disputes shall be resolved between the user and the Payment Processor.

   c) Bank-In Payments: Top-ups via bank-in will only be processed once the funds have cleared the bank and been

       approved by DC Clean.

   d) DC Clean Wallet: DC Clean offers users the facility to purchase and maintain prepaid credits through the DC 

       Clean Wallet. The DC Clean Wallet may only be used for in-app service requests through the Platform. DC

       Clean reserves the absolute right to revise the pricing of any credit packages, credit values, or applicable limits

       at any time without prior notice. All credits purchased are prepaid and shall not be exchangeable, returnable,

       or refundable once sold, unless required by applicable law or otherwise determined by DC Clean at its sole

       discretion. Users may top up their DC Clean Wallet through the following methods:

 

            i)   Electronic Payment Gateways

                 Users may top up and purchase credits for their DC Clean Wallet through electronic payment gateways 

                 operated by third-party Payment Processors.

                 The processing and confirmation of wallet credits are subject to verification and approval by the relevant                   Payment Processor. DC Clean shall not be responsible for any delay, error, technical issue, or failure 

                 arising from the services of the Payment Processor.

                 DC Clean shall also not be liable for any unauthorized use of a user’s electronic payment instruments,

                 including e-wallets, during or after the top-up process.

 

           ii)   Credit Card

                 DC Clean provides users with the option to make payments through credit or debit cards via payment

                 gateways (“PGs”) or Payment Processors operated by DC Clean’s affiliates, partners, or third-party service

                 providers.

                 By making payment through a credit or debit card, you agree to provide the necessary payment details,

                 including your card information (“Card Details”), to the relevant PGs or Payment Processors to facilitate

                 the completion of the transaction.

                 All PGs and Payment Processors used for payment transactions are required to comply with the Payment 

                 Card Industry Data Security Standard (PCI-DSS).

                 Your authorization for such transactions shall remain valid for as long as your account on the Platform

                 remains active. If you remove your Card Details from the PG or Payment Processor, or if you delete your

                 account on the Platform, the PGs or Payment Processors will not process any further transactions initiated

                 by you.

                 All payment transactions are subject to the applicable terms and conditions, privacy policies, and other

                 requirements of the relevant PGs, Payment Processors, and card schemes.

                 DC Clean shall not be responsible or liable for any errors, technical failures, unauthorized transactions, or                   disputes arising from payments processed through credit or debit cards. Any such disputes shall be   

                 resolved directly between you and the relevant PGs, Payment Processors, or financial institutions, except 

                 where such issue arises directly due to the fault or negligence of DC Clean.

           iii)  Bank-In

                 Users may also top up their DC Clean Wallet via bank transfer or bank-in. DC Clean shall process the top-

                 up request only after the payment has been successfully cleared by the bank designated by DC Clean

                 and upon verification and approval by DC Clean.

 

   6. Security and Fraud Prevention

       DC Clean retains the right to suspend or forfeit any transaction it reasonably believes to be fraudulent, illegal,

       or in breach of this agreement. In such cases, DC Clean shall not be held liable for any resulting delays,

       cancellations, or withholding of payments.

 

   7. User Accounts and Responsibilities

       Users who create an account on the Platform agree to:

       a)  Provide accurate, current, and complete information during registration and to update such information

            when necessary.

       b)  Maintain the confidentiality of their login credentials and be fully responsible for all activities carried out

            under their account.

       c)  Notify DC Clean immediately of any unauthorized use of their account or any other breach of security.

       d) DC Clean shall not be liable for any loss or damage arising from a user’s failure to safeguard their account

           credentials.

    8. Service Limitations and Liability

       a) DC Clean provides a platform to facilitate cleaning service requests but does not guarantee uninterrupted,   

           timely, or error-free service.

       b) To the fullest extent permitted by law, DC Clean shall not be liable for any damages arising from the use of 

           the Platform or services.

   9. Data Protection and Privacy

       a) DC Clean will collect, use, and process personal data in accordance with the Personal Data Protection Act

           2010.

       b) By using the Platform, users consent to the collection and processing of their personal data for the purposes

           of providing services and improving the Platform.

 

  10. Amendments to Terms

        DC Clean reserves the right to amend or update these Terms and Conditions at any time. Updated terms will

        be published on the Platform and shall take effect upon publication unless otherwise stated. Continued use of

        the Platform after such changes constitutes acceptance of the revised Terms.

  11. Governing Law and Jurisdiction

        The Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
